1. Acceptance and scope

These Terms of Use govern access to and use of https://joinapnea.org, its content, forms, publications and related online services operated by Asia-Pacific New Energy Alliance (“APNEA”, “we”, “us” or “our”). By using the website, you agree to these Terms. If you do not agree, do not use the website.

Additional written terms may apply to a specific membership, event, working group, project, publication contribution or service. Those additional terms will prevail to the extent of any inconsistency.

2. Eligibility and authority

Membership and formal participation applications may only be submitted by persons aged 18 or older. If you submit information for an organisation or another person, you confirm that you have authority to do so and that the information is accurate to the best of your knowledge.

3. Website use

You may use the website for lawful informational, professional and organisational purposes. You must not interfere with website security or operation, attempt unauthorised access, introduce malicious code, scrape the website in a manner that disrupts service, impersonate another person, submit unlawful or misleading material, or use the website to infringe the rights of APNEA or any third party.

APNEA may restrict or suspend access where reasonably necessary to protect the website, users, data, legal rights or operational integrity.

4. Membership applications and status

Submitting an application does not create membership, approval, partnership, accreditation, endorsement or any right to participate in an APNEA activity. Applications are subject to review and written acceptance by APNEA.

The first membership year is currently offered without a membership fee. This fee waiver does not create a right to free membership in later years. Before the second membership year, an approved member may be invited to continue under the membership terms and fee then in effect. Renewal is optional. APNEA will not charge or automatically renew a membership unless the member has affirmatively accepted the applicable renewal terms and payment process.

Membership categories, eligibility criteria, benefits, activities, participation opportunities and renewal arrangements may change prospectively. APNEA may decline, suspend or end membership where eligibility is not met, information is materially inaccurate, conduct is inconsistent with APNEA purposes, fees that were expressly accepted remain unpaid, or continuation would create legal, reputational, safety or operational risk.

5. Forms, proposals and submissions

Information submitted through a form must be accurate, lawful and reasonably relevant to the stated purpose. Do not submit payment-card data, identity documents, confidential trade secrets, special-category information or other sensitive material unless APNEA has specifically requested it through an approved process.

A submission is not confidential merely because it is sent to APNEA. Confidential treatment requires a separate written agreement. You retain ownership of material you submit, but grant APNEA a limited right to review, store, reproduce internally and share it with authorised reviewers as reasonably necessary to assess or administer the request.

6. Intellectual property

Unless otherwise stated, the website, APNEA name, visual identity, page design, original text, frameworks, graphics and publications are owned by or licensed to APNEA and are protected by applicable intellectual-property laws.

You may link to public pages and quote short extracts with clear attribution where permitted by law. You may not reproduce, republish, sell, modify, translate, distribute or use APNEA material to imply endorsement without prior written permission, except where a publication expressly grants a broader licence.

7. Publications and information

Website content and APNEA publications are provided for general informational and professional discussion purposes. They do not constitute legal, financial, investment, engineering, safety, certification, conformity-assessment, regulatory or other professional advice. Please read the Publication and Information Disclaimer.

APNEA does not guarantee that content is complete, current, error-free or suitable for a particular decision. Users remain responsible for obtaining qualified advice and verifying requirements that apply to their jurisdiction, technology, organisation and use case.

8. Third-party content and links

The website may include third-party content, contributor views or links to external services. Inclusion does not necessarily mean endorsement. APNEA does not control and is not responsible for third-party content, availability, security, terms or privacy practices.

9. Availability and changes

APNEA may modify, suspend, withdraw or restrict any part of the website or its content without guaranteeing continuous availability. We may update these Terms by publishing a revised version. Continued use after an update constitutes acceptance of the revised Terms.

10. Disclaimer of warranties

To the maximum extent permitted by law, the website and its content are provided on an “as available” and “as is” basis without warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement or uninterrupted operation. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, APNEA will not be liable for indirect, incidental, special, consequential or punitive loss, loss of profit, loss of opportunity, loss of data or business interruption arising from use of or inability to use the website, reliance on content, third-party services or unauthorised access beyond APNEA reasonable control.

Where liability cannot be excluded, APNEA liability will be limited to the extent permitted by applicable law. These Terms do not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

12. Governing law and disputes

These Terms are governed by the laws of Singapore. Subject to any mandatory law, the courts of Singapore will have jurisdiction over disputes arising from these Terms or the website. The parties should first attempt in good faith to resolve a dispute through written communication.

13. General provisions

If any provision is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with any applicable additional written terms, constitute the agreement governing website use.
